Law and Psychiatry

an educational resource site

My primary skill is as a communicator. As a physician, psychiatrist, psychoanalyst, forensic psychiatrist and frequent media expert, my task is to explain at times complex medical and behavioral information in clear, accurate and easily understood narrative. Whether talking with  attorneys, judges and juries, patients, colleagues, students or the media, or writing articles for professional journals or the general public, this is my core competence.

Complete C.V. of Mark Levy, MD, FAPA, Certified by the American Board of Psychiatry & Neurology with Subspecialty in Forensic Psychiatry

Definition and Brief Recent History of Forensic Psychiatry:

Forensic Psychiatry is a dynamic field of applied psychiatry that exists in the somewhat exotic niche between clinical medicine, psychiatry, and the law. According to the American Academy of Psychiatry and the Law  (AAPL), a division of the American Psychiatric Association, "Forensic Psychiatry is a subspecialty of psychiatry in which scientific and clinical expertise is applied to legal issues in legal contexts embracing civil, criminal, and correctional or legislative matters: forensic psychiatry should be practiced in accordance with guidelines and ethical principles enunciated by the profession of psychiatry." The field is currently in a state of remarkable growth and transition.

Although there have been psychiatrists in courtrooms within the United States and England, historically as far back as 200 years ago, in modern times, until about twenty years ago, Forensic Psychiatry existed only as a small "cottage" profession, among a tiny group of dedicated clinicians. These forensic psychiatric "pioneers" were psychiatrists and psychoanalysts who were interested in applying their knowledge of human behavior to the judicial process, both in civil and criminal matters.

Subsequently, with the advent of the American Academy of Psychiatry and the Law, the field has emerged as a unique interface between the two professions of law and psychiatry that is proud of its high standards of training and professionalism. AAPL has its own journal The Journal of the American Academy of Psychiatry and the Law  and its own code of professional ethics, "Ethical Guidelines for the Practice of Forensic Psychiatry" .

Since 1994, the American Board of Psychiatry and Neurology (ABPN) has examined eligible psychiatrists for Certification in the Subspecialty of Forensic Psychiatry. Currently, the requirements for certification include a one year post-psychiatric residency full-time Fellowship in Forensic Psychiatry (after completing the fourth year of post-graduate residency training in general psychiatry) in a program approved by the Accreditation Council on Graduate Medical Education (ACGME). Finally, ABPN certification in the Subspecialty of Forensic Psychiatry is awarded to those candidates who successfully pass a comprehensive three-hour written examination encompassing a broad range of subjects. Currently, among the more than 35,000 psychiatrists in the United States who have been certified by the American Board of Psychiatry and Neurology, only about 1300 have also been certified by the Board in the additional Subspecialty of Forensic Psychiatry. Although many clinicians practice "forensic psychiatry and psychology," an ABPN board certified forensic psychiatrist is both a highly trained and a relatively uncommon professional expert.
